Terms of Service

Effective October 30, 2026. These terms apply to purchases made through avatarhaus.com/en/ and the Stripe payment links shown there. The German-language terms at /agb apply to purchases made through the German site; where an offer states different terms in writing, the offer prevails.

1. Seller and scope

These terms govern all services of Avatarhaus, offered by HERO DREAMS LLC, 1401 Pennsylvania Ave. STE 105, Wilmington, DE 19806, United States ("we"), to businesses and professionals acting in the course of their business ("you"). We do not sell to consumers.

2. Services

We build a content system with AI avatars for you and, if you choose, operate it: set-up of avatar and voice, creation of videos and texts, set-up of the client area, and ongoing care. Scope, price and term follow the package you buy as described on our site, or your written offer.

3. No legal, tax or financial advice; no guaranteed results

We do not provide legal, tax or financial advice. We cannot promise reach, inquiries or revenue; we owe the agreed deliverables, not a particular business outcome. You remain responsible for compliance of your content with the rules of your profession.

4. Contract and payment

A contract is formed when you pay the setup fee through the Stripe checkout or accept our written offer. Prices are in US dollars, before any applicable taxes. Setup fees are one-time. Payments are processed by Stripe; we do not see your card details.

5. Build, acceptance and monthly care

When the build is finished we ask you to review and accept it. Monthly care starts upon your acceptance and is billed monthly via a separate subscription. Unless your offer says otherwise, care has a minimum term of six months and can then be cancelled month to month in writing (email suffices) effective at the end of the billing period. We commit to 3-4 posts per day once care has started, distributed across formats as agreed with you.

6. Your cooperation, consent and accounts

You provide materials in time (videos, voice recordings, images, texts, access) and confirm that you hold the necessary rights. An avatar or voice of a real person is created only with that person's explicit consent. You connect third-party accounts (for example TikTok, Meta, Google) yourself through the provider's sign-in; we receive an access token with the permissions you confirm, not a password, and use it only for the agreed purposes. Fees of tool providers (for example avatar and voice) are paid by you directly to the provider, without markup.

7. Content, disclosure and approval

Content is generated with AI tools and labeled as AI-generated where law or platform rules require it. You review content before publication; we publish only what you approved or what falls under an approval rule you set. You remain responsible for the accuracy and legality of your statements.

8. Ownership

Upon full payment you receive a non-exclusive, perpetual, worldwide right to use the videos, texts and images created for you for your business purposes. Our tools, templates and general know-how remain ours. Your avatar, voice and the content created for you are not used for other customers.

9. Confidentiality and privacy

Both parties keep the other's confidential information confidential. See our privacy notice for how we process personal data.

10. Disclaimer and limitation of liability

Services are provided as agreed; to the extent permitted by law we make no other warranties. To the extent permitted by law, neither party is liable for indirect or consequential damages, and our total liability is limited to the fees you paid us in the twelve months before the claim. Nothing limits liability that cannot be limited by law.

11. Changes

We may change these terms for the future. We will notify you in writing; changes apply if you do not object within four weeks.

12. Governing law

These terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Courts in Wilmington, Delaware have jurisdiction, where permitted. If a provision is invalid, the rest remains in effect.
